Expired OCTA Policy: What Happens and What to Do
An OCTA policy in Latvia does not last forever: a standard contract is concluded for one, three, six, nine or 12 months. When the term ends, so does your protection, often unnoticed, for example after a short-term policy. Here is what the law says about driving without valid OCTA, what happens after an accident and how to fix it quickly.
Can you drive or park on the street without OCTA
The Road Traffic Law allows only registered vehicles with compulsory third-party liability insurance to be used in road traffic. Without OCTA, the vehicle is prohibited from taking part in traffic. The driver must also check before setting off that the insurance is valid, so "I didn't know" is no excuse, even in a borrowed car.
Parking is not an exception either. The OCTA law states that liability is insured regardless of whether the vehicle was moving. You may skip the policy only if the car is parked in a non-public place where third-party access is restricted and it is secured so it cannot roll away or be used without permission. A car on the street or in a public parking lot does not meet this exception. If the car will sit unused for a long time, you can temporarily suspend its registration, and then there is no OCTA obligation.
What fines apply for driving without OCTA
The fines are set in Article 71 of the Road Traffic Law and expressed in fine units. Under the Administrative Liability Law, one fine unit equals five euros.
- For the car owner, for not having OCTA while the car is used in traffic: 70 to 130 fine units, which is EUR 350 to EUR 650.
- For a driver who is not the owner: 17 to 24 fine units, which is EUR 85 to EUR 120.
- If a camera records the violation without stopping the car and it keeps happening, the fine is applied once every 24 hours. So every extra day without a policy can mean a new fine.
The police check OCTA in the information system, so a paper policy is not needed. Also, the roadworthiness inspection is not carried out if the owner's liability is not insured.
If you cause an accident without OCTA
The victim is still compensated: damage caused by an uninsured vehicle is covered by the Guarantee Fund, administered by the Motor Insurers' Bureau of Latvia (LTAB). The limits match OCTA: up to EUR 6,450,000 for bodily injury and up to EUR 1,300,000 for property damage.
For the person at fault, however, this money is not a gift. The law gives LTAB the right to file a recourse claim against the owner or legal user of the vehicle if its liability was not insured. In practice, everything paid to the victim, including medical costs and repairs to the other car, can be recovered from you. Damage to your own car is never covered by OCTA, and the administrative fine comes on top.
A policy does not renew by itself
An OCTA contract runs for a fixed term and does not simply continue afterward unless you agreed otherwise with the insurer. A reminder email can land in spam, so it is safer to know the end date and set a phone reminder a few days ahead. Pay extra attention if:
- you bought the car recently: when ownership changes, the previous owner's OCTA contract ends early, so the new owner must take out a policy of their own;
- you previously chose a policy for one or three months;
- another family member uses the car. If the policy expires while someone else is using the car, that legal user must take out insurance in the owner's name, and if they do not, the obligation stays with the owner.
How to check whether your OCTA is valid
The easiest way is the OCTA check e-service on the LTAB website. All you need is the registration number or chassis number, plus the vehicle type. It only takes a moment and is worth doing before driving a borrowed car.
What to do if the policy has already expired
- Do not drive until a new contract is in place.
- Compare offers: a new policy can be arranged online in a few minutes by entering the plate number and the vehicle registration certificate number in the OCTA calculator.
- If the vehicle passport is not at hand, use the OCTA calculator without the vehicle passport: vehicle data is pulled from the register, and the policy arrives by email after payment.
- Check the start time. The contract takes effect when it is concluded or at the time stated in it, so if you buy early, you can pick the day the old policy ends and avoid any gap.
- Choose the term deliberately. A 12-month policy means fewer renewals and less risk of forgetting.
As a broker, Agento shows several insurers' offers in one place, but the key point is simple: never leave your car without valid OCTA, not even for a day.
